Court fee is stamp duty payable on the plaint when filing a civil suit. For money suits, it is ad valorem (a percentage of the claim). For non-pecuniary suits (injunction, declaration), a fixed fee applies. Rates are set by each state's court fees legislation.

Ad valorem means according to value. The court fee is a percentage of the claim amount, typically 1-5% depending on the state, usually with a maximum cap. It is paid by affixing court fee stamps on the plaint.

Under Section 16 of the Court Fees Act, court fees are partially refundable on settlement or compromise. Typically 50-75% is refunded if the case settles before trial. Rules vary by state - check with the court registry.
