Under NI Act Section 142(b), a complaint for cheque dishonour must be filed within 1 month of the cause of action arising - that is, after the 15-day payment window from the demand notice expires. Delay can be condoned by the Magistrate under Section 142(b) proviso.
Under Article 55 of the Limitation Act 1963, the limitation for breach of contract suits is 3 years from the date of breach. For money recovery without a fixed repayment date, limitation runs from the date the money became due.
Section 5 of the Limitation Act allows courts to condone delay in appeals and applications (NOT original suits) if sufficient cause is shown. For original suits like money recovery or property, the limitation bar is absolute and courts cannot entertain the suit after the period expires.
