The Limitation Act 1963 prescribes the time within which civil suits must be filed. For most money recovery suits the period is 3 years from the date the right to sue accrues. For suits on a written contract the period is 3 years. For suits relating to immovable property the period is generally 12 years. Court fees in India are governed by the Court Fees Act 1870 as amended by each state. For money suits the fee is ad valorem - a percentage of the claimed amount subject to a maximum cap set by the state. For declaratory suits, injunctions, and probate matters fixed fees apply. A legal notice under Section 80 of the Civil Procedure Code or under the relevant statute must contain: (1) Name, description and place of residence of the claimant, (2) cause of action stated with full particulars, (3) relief or remedy sought, (4) a reasonable time period (usually 30-60 days) given to the opposite party to respond or comply, and (5) a statement that suit will be filed in default.
